GET THE FACTS- Palm Beach County Short Sales

Get the facts about Palm Beach County Short Sales or short sales for anywhere in the state of Florida.

I have been on the phone this week with 3 homeowners and 1 real estate agent who have been so misinformed about short sales. It made me think that there must be a lot more people out there that are misinformed.

Things change often, rules change often in Short Sales. What a lender says is the way it is one day may change tomorrow.

 

Two of the people I spoke with this week were given incorrect information from agents who have a Certified Short Sale designation or certificate or loss mitigation certification. Just because someone has been certified does not make them an expert. Check their references of homeowners whom they have successfuuly negotiated short sales for.

 

One of the callers had her house listed with an expert short sale agent who gave her incorrect information about if she would get a 1099 or not.

 

These are the facts:

  • If your home is your primary residence and has been for 2 out of the last 5 years, the homesteaded property in the state of Florida you will get a 1099 for the short fall in January of the following year. However, the debt relief act that President Bush signed into law says that the IRS will not treat that short sale loss as a gain or ordinary income. This law is in place until December of 2009. Most lenders are going to send one out to you because they do not have systems in place to differentiate from those who should get one and those who don't. You will need to take that to your accountant and make sure your accountant knows about that act.
  • If the property that you are doing a short sale on is NOT your primary residence, meaning that you used it as an income property, bought it for your kids or parents, etc, than you will get a 1099 and it will be according to the IRS treated as income for tax purposes. I think this stinks but I can't seem to get the IRS to listen to me:). What you can do is talk to your accountant. You can see if you are insolvent. The insolvency then may wipe out your gain. Also, remember that you have losses to report as well. Make sure you keep your closing statements because those closing fees, some of them you can add to your loss. I am not an accountant so check with an accountant to help you mitigate the damage. Most of our investor listings are so upside down that they will be insolvent at the end of the day.
  • If your property is an investment property you may still qualify to do a short sale which is still way better than a foreclosure. One of the biggest myths is that you can NOT do a short sale if this is an investment property. We have closed many investor short sale properties with very little to no deficiencies.
  • If you have money in the bank, have a job and have retirement accounts you still may be able to do a short sale. This is another falacy running wild out there! It is not true that you can not do a short sale if you have money. What is true is that the more money you have and the better your credit scrore, the more money the lender will expect you to bring to the table to mitigage their loss.We have negotiated $140,000 requests from lenders to homeowners to pitch in down to $27,000 and less depending on what the money our client has is used for. It is far better to pay a deficiency of $27,000 and make it go away than getting a deficiency of the entire $140,000 plus more after a foreclosure.
  • In the state of Florida which is a deficiency state you may or may not get a fully satisfied paid as agreed status on your short sale. We will write another article with the different types of outcomes you can expect to happen. If you have a HELOC as a second, that is a Home Equity Line of Credit or PMI, Private Mortgage Insurance you will most likely these days not get away with getting a totally and fully satisfied mortgage reporting. HELOCs are treated differently than mortgages and most of them require some sort of payment. We have been able to get this amount reduced and have been able to get the amount negotiated from buyers or the sellers borrowed the money from their parents, ect to make it work because it is still far better than a foreclosure.

BPOs for Palm Beach County Short Sales- It May Not Be Your Lender!

All I have to say is, Hello???? Are you on Earth??? That goes to the 2 different agents who take an assignment from outside of their market area, won't take our comps, won't listen to us and turn in their BPOs to the short sale lender who then is even on a farther planet away from Earth, like Pluto maybe? Ooops, they just discovered not long ago that Pluto was not actually a planet. So maybe this person is just zoning out somewhere.  short sales palm beach county agents

We list a lot of short sales. Nestor is dead on with his pricing. He does know the market. We listed this one condo where the owner owes like $300,000 on the unit. The unit is in one of those apartment buildings that they converted to a condo. That is called a condo conversion. The unit is on the third floor and there is NO elevator! So here in Florida that rules about half of your buyers right there!

The pricing per square foot, location and all of that came to a list price of $189,000 6 months ago. We get an offer of $160,000 about 3 months later. Not a bad offer at all. If you take 85% of $189,000 that is right at $160,000. Nestor predicted this property would sell for 160K.

So the short sale lender calls on yet another agent who lives and works in Miami to come up here to West Palm Beach area to do this BPO. Why these agents don't just tell the bank they are not qualified to do a BPO in a market they have no clue about is beyond me. I have written several posts about these agents who continue to do BPOs that don't know the values or how to do a BPO. It is up to the agent to tell the lender that they don't work in that area. The lenders data base pulls up the agents from a roster in which the agents applied and placed their areas that they work in. I will continue to write about this until these agents stop doing this.

3 months after we have it listed she comes back with a BPO price of $189,000. But the problem is the market has gone down in those 3 months! So the value at that point in time is $173,000 so an offer of $160,000 is an excellent offer. SO the short sale gets turned down and the negotiator's manager tells us to list it back up at $189,000. OK, it will just sit there.

Time goes by. No showings, no calls. It is the PRICE!!! Amazingly the same buyer was still interested and stayed in the deal. As soon as we reduce the price back down to 169K; the showing start again.

Now that more time has gone by we resubmit the offer with a new BPO showing the prices have dropped even more and that an offer of $160,000 is a great offer. Because the time has elapsed the negotiator is able to order another BPO. He would not even pay attention to the detailed one that Nestor sent in. But he is bound by the rules that have been set up that say that they can only go with a lender ordered BPO. This is not just a negotiator, this is higher up.

So they order a new BPO and GUESS WHAT!!??!!

You will not believe this or maybe you will because you have seen it all!

Another agent, this time from another county up north comes down to do the BPO and we just got called today that the BPO is at $195,000!!!!!!!!!!!!!!!!!!!!!!!!!!!

So the prices went up in a condo conversion in Palm Beach County Florida in the last 3 months ??? I don't Think SOOOOO!!!

Where are the closed sales that we had on our BPO for 160K, 155K, 165K?????

This is yet another reason why we don't agree with having the BPO done before the listing and then telling the listing agent what to list a short sale for. We know our market, we know what to list property for. These agents who do BPOs have no accountability and no culpability and yet it is their incompetence that ends up with the effect of the sheriff at the door and another foreclosed home that could have been sold as a short sale!

We spend hours and hours negotiating these types of issues and this causes countless hours of needless frustration. I understand that we are representing the seller on the short sale but the lenders need to take in account our BPOs that we do and open their thinking to finding out about the markets.

Short Sales- Countrywide Changes Short Sale Procedures Again!

Short Sales- Countrywide changes their short sale procedures for the third time in the last 16 months. It seems they just do not understand how to get through the short sales they have stacked up on their desks. Now- which road do they take? Which way do they turn?short sales countrywide public relations problems

As you may recall the last time I wrote about the changes; Countrywide had decided to ship most of their files off to India for processing. Well, then came the problems. The employees there are trained to be like robots. They go down a check list and if anything does not fit the mold they deny the loan modification, deed in lieu or the short sale. This created a lot of problems because rarely is a file sent in totally perfect no matter how hard one tries.

We make sure we use a check list for our short sales but there are always situations in which all the documents will not be in the package. For instance, we have a seller who does not work and is not required to file tax returns so they would be denied because the tax returns would be missing. Instead of picking up the phone and asking us about our explanation for the tax returns they just deny the file. 

Countrywide then decided that was not the greatest of ideas and pulled the files back to the U.S. but now instead of expedientely going through the files they decided to break the short sale files up into 3 departments. Now they will examine every single file and call the real estate agent or homeowner regarding all missing documentation. The file will remain open.

They can not even handle the complete files and now they will address all files! Hmmmm, I wonder how much longer short sales are going to take now with Countrywide.

We have 2 listings that have been going on for over one year with Countrywide.

The other important thing to know about Countrywide is that they treat each offer as a new file. We had one offer in, the buyer walks because CW takes too long, then we get the next buyer and can substitute the buyer. Well, unlike all the other lenders we work with, CW does not let you sub a buyer. The file with the first buyer has to be actually closed down and then you have to get a new file started!

Back to the back of the line! So while we can get an approved short sale offer through in one week with many lenders if a buyer walks; NOT with Countrywide! You are looking at another 30 to 90 days! WOW!!! Some improvement!

If your homeowner has a deed in lieu request or a loan modification open; you can not also work on the short sale. Those files need to be closed first. We have one with a loan mod that was declined but until we have an offer on the short sale they will not close the loan mod file. I wonder if this has anything to do with padding the books in any way?

Oh, another thing- Country wide will no longer accept offers without the sellers's signatures on them. We use this in order for us to accept multiple offers in certain situations. When I asked why that is, the team leader told us that the offers not signed by the sellers are creating buyers who are walking away from the deals in the middle of the short sale!

EXCUSE ME!!!! That has nothing to do with it. The buyers are walking because they don't want to wait 6 months to 12 months to buy a house!!!!!! What part of this picture do they not understand??? The buyers are walking because of the clause in the offer that says 'the time period for acceptance is 45 days' or whatever days is put in that box! That means Countrywide that if you don't give the buyers an answer by that time they do not have to buy the house!!! HELLO!!!

If they pay our fee; Nestor and I will go into Countrywide and organize their short sale department and make it run like a well oiled machine! It is NOT rocket science! But you do need to know short sales and real estate!

Hmmmmm, and banks want to be in the business of real estate! I think some public relations classes are in order!

Wellington Florida Village Council Approved Cameras For Traffic Lights

Wellington Florida Village Council just approved the installation of cameras on our traffic lights to catch photos of those that run red lights at intersections. Royal Palm Beach already has them installed and much of Palm Beach County also.  Wellington Florida luxury homes for sale

 

The Village of Wellington code enforcement will be fining those that run red lights. The proposed fines are $125 each time you run a red light for the first two times and then go up to $250 for the third time over a three year period.

The cameras will be moved around to where the most infractions are. They are going to contract the installation of the cameras out to companies that specialize in this field.

This new ordinance is set up and approved for public safety not as an income generator the village said. They do think that the revenue brought in by the fines will pay for the cameras, the work involved in working them and levying the fines. It may even generate a profit but that is not the goal.

People who run red lights will think twice about doing so and also will not always know where the cameras may be at all times. This should also lesson the accidents caused by those who run red lights.

Below is one of the search terms that I used, "Charlotte NC Carmel Park."  Below are the results of the search.  Now I'm not number one--a paying company is but, my listings are right up there below the paying company's link.  Honestly, when I do a search myself, I always skip BELOW the paid ad because I want the 'real' information--ALWAYS!

Live In Binks Forest Preserve-474 Cypress Circle- Wellington Florida 33414- Not A Short Sale

Are you looking for a home in Binks Forest Preserve, the Lennar built side that is NOT a short sale?

  You will feel right at home at 474 Cypress Circle in Wellington Florida.

This part of Wellington has always been one of my favorites. I was here watching these homes being built by Lennar. I remember bringing buyers to the sales office and how excited buyers were with the Lennar; 'everything included' concept that was the Lennar tagline. What Was The #1 Most Googled Word The Day The Gators Beat The Sooners?

What was the #1 most Googled word the day that Florida Gators beat the Sooners? This made headline news! In fact the front page of last Sunday's Palm Beach Post had Tim Tebow's faith in the headlines in a mostly positive way.tim tebow john 3:16

The story started out very exciting as the headine read, "Tebow's Faith Catches Interest of Fans."

Well, the most Googled word that day was far ahead of Oprah, Obama Speech, Chris Leak and What is a Sooner. The words were what Tim Tebow had written on his eye-blacks. JOHN 3:16. This verse was the most searched word on Google as soon as everyone could see Tim Tebow's eye-black. The next day, John 3:16 remained in the top 10.

I was surprised that the Palm Beach Post would even write this article. Of course they did take it for a negative spin later in the article by bringing up some insane ball players who are in prison who used Jesus for their excuse.

Tim Tebow carried his message of faith to all who would watch him play football that great victorious day. Tim said "I knew there would be a lot of people watching and this verse represents Christianity in a very good way... it's sort of the essence of Christianity. So I felt people would say:Hey what's that verse? Hopefully some people would look for it."Well more than just some people looked it up.

Right on the front page of the paper the verse appeared as well:

John 3:16 For God so loved the world that he gave his only begotten son, that whosoever believes in him shall not perish but have everlasting life.

Tim used to wear the verse Philippians 4:13 which says: I can do all things through Christ, who strengthens me. But one week before the big game changed the verse to John 3:16 because he felt it would have more impact on the millions of viewers all over the world that would be watching the game. And he was right.

Tim Tebow made more than one touchdown on that championship day!

This is where Nestor gets all of his suits tailored. We have been going to Nut In Fits for over 10 years. Lolita has been in the same store all this time in the original Wellington Mall, the little one on the corner of Wellington Trace and Forest Hill Blvd and was there before the new Wellington Green Mall was built.

Nestor bought me this new suit for Christmas and I needed to get it tailored so he dragged me out to Nut In Fits to get my sleeves taken in and the hems on my slacks taken in. I am a very good seamstress, in fact, I made all of my children's clothes when 5 of them were little. I made all their church clothes to match, I made the girls pageant dresses and all their play clothes and pajamas. Of course I don't know what happened to the time and why did I have all that time back then to sew all the family clothes in the 1980's but now I don't even have time to hem my own pants!

So here I am getting my suit tailored by Lolita. She is very popular. She does a lot of Equestrian tailoring from the show costumes for the dressage and jumpers to the gala gowns for the evening events after the horse events are over.

We met this lovely young girl here who drove all the way up from Miami for Lolita to take in her dresses because she had lost 24 pounds. That is about an hour or so drive. It was a strong testimony of what a good tailor Lolita is.

Well, I found those 24 pounds and more. I have been fighting buying any new clothes because I don't want to accept the weight I have put on. If I don't have the clothes to get comfortable in then I will just have to lose the weight. However, Nestor surprised me with this new suit.

The original Wellington Mall is a small center that also has our little tiny Wellington Post office in a little kyosk in the center of the mall. You can view the nice fountain and statues of children which is the theme of this center.

Become Famous On Twitter Contest Winners!

My Twitter friend @Dawn_Abraham, @cynthiambarns and I came up with the idea to have a Twitter contest based on not just quantity of tweets but the quality of them as well. In social media it is all about paying it forward.twitter contest

There are many applications created that tell you who has the most followers and such but there really was not anything for the regular gal and guy who is using twitter to pay if forward each and every day.
