Why Is My Lender Filing Foreclosure Against Me When I Am Doing A Short Sale? 


Actually if you are doing a HAFA short sale or a modified Fannie or Freddie Short Sale your lender is supposed to suspend your foreclosure until such time as they make a determination as to whether they will accept your short sale or not. Florida short sales and foreclosures

If you are not doing a HAFA or your lender turns you down for HAFA or does not participate in HAFA- then the way it works is this: 

Your servicer, the lender that is accepting your mortgage payments in behalf of the note investor has a fiduciary duty to protect the investors who they service the loans for. You are the customer to that servicer while the one who owns your note is the client of the servicer. There is a big difference between the two. Your lender does NOT have a fiduciary duty with you. 

When you apply to do a short sale the servicer does not know if your file will get approved or not right at first. Once you become delinquent on your mortgage payments that servicer has to follow legal guidelines and one of those steps is to go through the process of the foreclosure timeline. 

In case your short sale is not approved the lender does not want to take the chance of having to begin the entire foreclosure process all over again or to lose any of their rights in the foreclosure process. 

Most of the time there is the left hand not knowing what the right hand is doing along the way. Once a foreclosure starts- it leaves the hands of your lender from a legal perspective and is turned over to the lender's legal counsel who is going to be in the state where your property is located in and that location is usually in a different place geographically than where your lenders' short sale department is. So there are logistics involved in all of this also. 

The best thing that you can do is to stay in touch with your lender no matter who uncomfortable that feels to be in the present. You don't have to answer the phone every time they call but once every two weeks or so let them know you have not abandoned your property and you are working for a successful short sale with your real estate agents. 

Ask your real estate agent to get in touch with your short sale negotiator at your lender and work together to get your foreclosure dates postponed if you are in the foreclosure process.

That is one of the most asked questions we get. We get calls after homeowners have been trying for months to get a loan modification.

The number one reason that loan modifications get turned down is because of misinformation and the path by which the homeowner takes in order to try to get their loan modification through. Choosing the right advocate is crucial in the loan modification program. 


Homeowners need to be very careful on who they choose. Most of the companies advertising on Television are making false promises. If it sounds too good to be true, it is.


The first rule is to never pay up front money to get your loan modification started. The payment for services should be at the successful approval of a permanent loan modification. 


In the state of Florida it is illegal for any loan modification company to ask for prepayment for services. 


When you call those 800#s you are going to get a person who's job it is to get you into the system. Their only job is to process your information. They are not going to tell you whether you qualify or not. 


This holds true with going direct to your lender also. The person who answers the phone is there to get the number of applications up so that they can show the government that they are taking loan modification applications. 


You are just a number to them. This is hard to grasp since most of us would never treat another person this way, we would not string people along giving false hope. 


Before you ever even call your lender or hire someone to do a loan modification for you there are a few questions that you can ask yourself: 


  • Are you unemployed? If you do not have a job, you are not going to be approved for a loan modification. 

  • Is your mortgage payment/taxes and HOA fees more than one third of the income you bring in? If so, you are not going to get a loan modification because of a list of guidelines they go by. 

  • Are you an investor? If you are going for HAMP or any government sponsored loan modification program you are over 97% likely to be rejected if you are not living in the property that you are requesting the loan modification program for. 


These are the simplest of questions that you can ask yourself to see if it is ever worth going through this long drawn out process.

Are You Ready For Your National Internet ID Card?  Yes, I know it is voluntary... for now....

So now we are so ‘stupid’ that we can not longer be trusted to create our own passwords to the internet, our own passwords to log on to our bank accounts and to manage our own passwords to our websites and blogs. 


They think they know better than we do in how to protect our private information. 


Hmmm, how’s the Wikileaks thing working out for you? I see, the government is REALLY good at protecting their secrets! 


And yet, the administration is pushing for National Internet IDs!  Do you know which other country has a National Internet ID? 


The government has been trying to regulate the internet, the last free place on earth where free and even some non free people have a voice. It is the last frontier of free markets, free enterprise and free speech. It is the last place on earth where you can start a company and make millions of dollars in just a few years. 


Of course, the government has been trying to figure out a way to tax the internet, control the internet, monitor the discourse on the internet and be able to shut down the internet under the guise of security. Remember what Benjamin Franklin said years ago: "Those who trade liberty for security deserve neither." Those words are so true.


And we the people must fight this at every turn. Remember, don’t forget, how they do things to make it so you don’t protest against it. They do it by: 


 

  • Slowly weaseling their way into it, 
  • Creating “voluntary” programs ( that always turn into mandatory at some point)
  • Installing regulations that are too hard to meet for those who choose not the “voluntary” way, 
  • Creating the illusion that this is best for all the people 
  • Creating the false sense of security, feeding into your fears. 

 


This kind of manipulation is evil and cruel especially when they capitalize on your fears. 


What better way to establish Internet Tax than through National ID cards. 

After all, how are they planning on paying for the National ID cards? 

Remember when they promised ( most of you are too young to remember) that the creation of the social security card would NEVER lead to using it for Identification? 


Think about it. 


How much do you trust the government with your personal information, your private information and your passwords to all your bank accounts, etc? 


I would rather have control over my own passwords to anything and everything I do online. If I lose my password I only have myself to blame. If someone hacks into one of my accounts, then I deal with it and move on. 


The National Internet ID would give you one password and one username to use all across all your online dealings. So that means you would have the same password to get into your Facebook account as you do to get into your bank account.  


Now, that sounds like a super recipe for Identify Theft!!! 


Not only that, the government would see every website you visit, every online purchase you make and every comment your write. There would be no anonymity. 


Write to your congress representatives to tell them to have government stay out of the Internet and stay out of managing every detail of our lives. Tell your leaders to grow a spine! 


A bill like this has been tried and failed. That is why they are doing an in and around Congress to get this done.


Call your congressmen and congresswomen today to tell them to take a stand for our constitutional right to make sure that the laws that are created are created in Congress and not by government bureaucrats, committees and regulatory agencies who bypass the constitution.

Travels In Real Estate- Regina Saskatchewan- Part 1


Well, we arrived here in Regina Canada on Thursday. When we arrived here it was -48 Celcius which is super cold in Fahrenheit. 

Our little guy and I grabbed a Limousine at the airport to take us to our oldest son's house to see our brand new grand baby! 

When we were getting packed up looking for warm clothing in Florida to come up here with I kept telling our little guy that it was going to be cold. Since he has never seen or been in snow and he does not like to be cold in Florida I was trying so hard to get him to understand this concept of super cold.

That was a waste of my persuasion techniques because he has not been cold at all since he has been here. He LOVES the snow! We learned quickly that at this time of year you wait to get here to buy your winter clothing because everything is on sale up here! We could not find snow boots in Florida and here in Regina we got boots for only $20!

I love to travel and learn about other places, people and cultures. My parents blessed me with the wonderful opportunity of traveling the world and that gypsy feature has remained with me. I have been immersed in discovering Canada since it has been over 15 years since I have been to Canada. When we lived in Seattle we traveled to Vancouver BC many times a year. However, I have never been to Regina Canada. Of course, now that I am so politically involved the culture of politics in other countries is also of great interest to me. I will post more about what I am learning later. 

I forgot my camera reader and my camera usb adapter at home so I took these photos and videos with my iPhone. I have lots of photos on my camera and I will post those after we get back home. 


Regina Canada Snow Trip

As soon as we got to the house Tristan jumped right into snow! There was this large pile of snow next to the house. He was right at home in the snow. 

Yesterday we took a walk to the mall and Safeway. I have not been to a Safeway in over 20 years! It was a great walk in below freezing temperatures but it was invigorating, fresh and clean. After we left Safeway we called for a cab to take us back to the house with our groceries. Tristan came up to me and said, "Hey Mom, I have a seat for you!" I went outside with him and here is the seat he had for me: 

We are having a blast and our new grand daughter is SO beautiful and good. I will share photos soon.

Why Does Your Short Sale Seller Care If We Give Him A Low Ball Offer?

Why does your SHORT SALE Seller care if we give him a low ball offer? 


This is a very common question we get from buyers' agents and from their buyers when making offers on our short sales. They don't understand why a seller would care about what kind of offer they get on their short sale.   florida short sale experts

There are very valid reasons why our sellers care about the offer that they get when they are short selling their home. 

Before we talk about why let's make it clear that the offer on a short sale property is a bi-lateral agreement between a buyer and a seller and in a short sale the seller is not the bank, the seller is the owner of the property, the person or entity on the title to the property. This is based on a deed state- Florida. So therefore, the bank is NOT a party to the contract. The bank is NOT going to sign the offer. The bank is NOT going to become a party to the contract. 

However, there is a clause in the contract that states that the seller can not close without his lender agreeing on taking a lesser amount owed to them by the seller. 

The first and most important reason to care about the offer price is if the seller is facing foreclosure. If the seller is facing foreclosure than time is of the essence. While we can in most situations get the lender to hold off on final foreclosure dates there is no guarantee that they will. So getting a close to market value offer is going to help speed up the process of getting to a closing. 

The banks are NOT approving short sale payoffs based on way below market values. The lender is approving a net loss. The lender does not depend on the listing agent nor on the buyers' agent to get a market value. They hire a third party, either an appraiser or a Realtor® to get them a market value. Then they look at the market value and the offer and then calculate the net loss to them, at which time they will reject, counter or accept the loss. 

No matter how many late night get rich quick in short sale shows you are watching you can not make it so. 

So our sellers must calculate the risk in any offer they receive. They have a lot at stake in choosing an offer. 

For the record, the short sale listings we have are not on the market very long and most of them will get multiple offers. While we are in desperate times we are not accepting desperate measures especially ones that can hurt our sellers. 

The next reason for not sellers caring about how much the offer is- is because we are a deficiency state. Many of our sellers are investors so they will be 1099'd on the loss- this may move them into a higher tax bracket and that could be disastrous as they are usually not in a position to pay that increase. So they must look at the loss that is going to be considered income by the IRS. Also, if our sellers are investors they must also look at the chance of a deficiency and they wish to mitigate that amount. 

The seller does not want to have their home off the market for a long time while we negotiate a short sale for them only to have to put the house back on the market again because their lender rejects the amount of the loss. The closer to market value we get an offer the more the odds are increased in the favor of the seller getting their short sale terms accepted.

Atlas Shrugged Video Contest and The Book That Keeps On Selling

 

How does a 50+ year old 1000 page book ( other than the Bible)  still be on the best seller lists?


How does a 50+ year old novel written in the 50's still stir so much passion in those who read the book? 

How does a book have the staying power, the though provocation and the inspiration to act 50 years and more after
the author wrote the book? 

What book is this do you ask? 

It is none other than one of the greatest novels of all time, Atlas Shrugged by Ayn Rand. 

 


This is because you either hate the book or love the book. This book stirs within most who read it emotions. You feel, you get into the charactors in the book. But more importantly Atlas Shrugged is read because of the principles which ring true in the book. Many people's lives have been turned from despair to passion, from feeling inadequate to resolving to become all that you are designed to be. There are plenty of critics as well as fans. Angelina Jolie is one of her fans and agreed to be the star in the movie based on the Atlas Shrugged plot. 

Interesting when you see the chart through the years of when the most Atlas Shrugged books are read. The sales of the book go up whenever there is high debt, too much government intervention in the private lives of citizens and during recessions. This book has sold over 6 million copies and last year alone it sold over 500,000 copies. That is pretty amazing after 50 years! 

AtlasShrugged.com just finished up with a contest for the best videos about what you learned from Atlas Shrugged. I loved the Lemonaid video the most. It came in second place in the contest. The first thing since I home school was turn the Lemonaid video into a class discussion for our 8 year old son. After we watched the video together, I asked what did he think of the video. Since the boys in the video looked to be around the same age as our son, we thought this would be a perfect discussion about integrity in your work and also that which you earn is your own private property and no one has the right to plunder it from you. 

It was very interesting to see Tristan's reaction and conversation about what he took away from this video. I posted the video below so that you can watch it and sit with your kids whatever age they are to watch it and then use this a learning and teaching moment. 

Tristan told me that he did not understand why the father told the boy making the money to share it with the lazy kid across the street. 

He said that if it was 'April', the girl that lives across the street from us who is mentally and physically handicapped that he would go over and help her with her lemonade stand and he would have her do what she was capable of doing and he would do the rest and then share the money with her. That is because she uses sign language and grunts but she has a great smile. Tristan knows that she brings her smile to the table and he can be her voice. She can help set the table but he would pour the lemonade into the glasses because she can not pour. She does ALL that she is capable of doing and he does the rest unlike the boy who just sits there and chooses to be a lazy brat. 

What he took away from this lesson was so much more than what even the book could teach us. He turned the lesson into a spiritual lesson- that capitalism works and that in our own free will we choose to help those we choose to help and we should not be forced to help those someone else chooses to help. WOW, I was floored! An eight year old teaching me! Yes, he teaches us every day. 

 

Florida- The Only State With NO Snow So Far This Year!

 

By yesterday every single state in the United States including Hawaii had snow except for the state of Florida. 


Even in Hawaii - seven inches of snow fell on Mauna Kea, the state's highest point. 

Even though the Arctic air is flowing across our state of Florida we are only getting into the upper 30's at night.
With the wind chill it feels more like the upper 20's. 

But in the daytime our weather is still reaching into the 70's which keeps the ground too warm for snow. 

Our little guy really wants to see snow. He was born here in Florida and unlike all the other kids, he is the only one 
who has not lived where there is snow. But he will be seeing snow next week as we go and see our new granddaughter in Canada.
He has no idea that it really is cold! 

When you get tired of shoveling the snow and driving in ice- come on down to the Sunshine State!

Wellington Kicks Off Polo Season!

Ah, there is such beauty in the grace of the game of Polo- the speed at which the horse and rider glide across the field is smooth and exciting at the same time.

The International Polo Club Palm Beach is in its' eighth year here in Wellington Florida.


 Of course Polo has been played here for years prior but The International Polo Club Palm Beach is a very popular Polo Club. This season is going to be largest Polo season on record here in Wellington Florida. 

Eleven teams will be playing here this year in their 26- goal tournaments. If you like Polo, then Wellington is the place to be. 

The International Polo Club Palm Beach hosts the most elite of all Polo Tournaments which are: 
  • the Piaget Gold Cup, 
  • the C.V. Whitney Cup 
  • and the U.S. Open Championships. 

The club has replaced the big tent with a permanent two story building for viewing the matches.  This building cost nearly $2 Million. You are still welcome to tailgate at the games.

Family Times Bring Big Smiles! The Babies Are Growing up so FAST! 


This Christmas was the first Christmas that we did not have almost the entire group of kids here for our Christmas Eve celebration yet it was still very memorable. After all, how can it not be with little ones running around all over the place with their innocent laughter and bright smiles?

Each Christmas it is a tradition in our family that we celebrate Christmas on Christmas Eve. We gather around the tree with home made goodies and snacks to nibble on while listening to the telling of the birth of Jesus and singing Christmas songs. After that, we listen to our favorite Christmas song while watching the video clips of Joseph and Mary's trip to Bethlehem and the birth of our Savior in a lowly manger to resurrection- Mary Did You Know. I love that song so much and cry every time I watch and listen to it. You can share in the joy of that video here- I posted the video here.

After that we open up our gifts. The youngest child gets to go first. He chooses a gift, sees who it is for and gives it to that person. Then we all watch that person open the gift. After the person opens the gift she or he goes to the person who bought of made the gift to thank them with a hug and kiss. This continues until all the gifts are opened. We have taught our children reverence this way to the meaning of Christmas. They never really believed in Santa Claus although Nestor dressed up as Santa Claus when the kids were smaller and he would then knock on the door on Christmas Eve and visit the kids but they all knew it was really Dad. Our goal was never to make Christmas a commercial day. It is a day to give and receive with grace and humble thanksgiving.

Now most all of our children are grown up and many are starting families of their own. The tradition continues and our children are loyally carrying this tradition on. This year only our two daughters and their babies and our son were here in our home for Christmas. Our oldest son lives in Canada and he and his feince just had a baby girl named Misha on October 1st. 

Our second oldest son is the one that moved to San Francisco right after Thanksgiving, he is the banquet Chef at the Fairmont Hotel in San Francisco. Our third oldest son and his new soon to be bride are going to have a baby in August. Then our daughter, Milet was here visiting from Orlando with her baby.

Tirzah our next to youngest daughter was here with her baby boy- this cutie pie that is totally squeezable! But no one could get photos of him because he won't stay still long enough at two years old! Next time. 

Our next daughter was in Texas and so was our youngest daughter and our next to youngest son. Here is a very nice Christmas photo they sent to us of them.

Then we have our little one, our son that Nestor and I had together- our miracle child, our pride and joy- he is 8 years old and he of course was here for Christmas with us this year.
