So If You Know Your Listing Price Is NOT Going To Get Approved....

So if you KNOW your listing is NOT going to get APPROVED at that price why do you have it listed at that price?

There are two sides to this issue-

One is from the listing side- your answer to me is that you want something to get the ball rolling.

Understandable, however, there is a code of ethics IF you are a member of your local Realtor® to follow and most states have false advertising statutes that you legally are bound by. Of course, you don't HAVE to obey either and you can CHOOSE then to accept the consequences of your actions or you can gamble that no one is going to take the time out of their busy days to file a complaint.

I do have valid counter points from the listing side but those are diverting from the actual point of this post. Suffice it to say- there are circumstances wherein there is no knowledge of what would be accepted or not.

The other is from the buyer side-

You as a buyer agent are supposed to do your own due diligence prior to showing your clients properties.

If you are looking out for your buyers one of the things you don't want to do is to get their hopes up only to have them come crashing down.

So you can show listings that are obviously NOT going to sell for even 10K above list price and look like a dummy when you start blaming the listing agent for not representing correct pricing or you could explain WAY before even making the appointment to show the home of your buyers' dreams to them- making full disclosure- that this house is NOT going to sell for the list price based on the comps you have pulled up.

Now your buyer can make an informed decision whether they want to gamble with whatever their offer price is and see if the short sale lender is going to counter or accept.

Sometimes I hear buyer agents tell their buyers that the short sale lender is going to have to adjust their accepted price if the buyers' appraisal comes in lower for the house. While this may sound logical- banks are not logical and there is no comfort level to give to a buyer that proves this is the case. Many times the short sale lender is not going to budge off their net they want even with an appraisal staring them in the face with a different number.

It all comes back to each party being responsible for their own stuff, their own clients and their own choices and decisions.

You may not be able to control the actions of others, but you can most certainly control yours.

One of our daughters went to a coupon class about a month ago. She and her sister do not want to be in debt for anything other than a modest home, even their cars are almost paid off. They only have credit cards to use as ID and for online purchases which they then try to pay in full each month.

They did not want to go alone the first time so I told them I would show them how to save money using coupons and the sales, especially the buy one get one free sales each week. Since we go to the store anyways, I thought I might as well take them with me. We can have some girl time together.

If you are struggling paying your bills- you need to pay attention to this post.

If you are in debt and want to get that debt paid down and eliminated- you need to pay attention to this post.

If you make money but love to save and have more money at the end of your paycheck- then you need to pay attention to this post.

This is serious saving!

This is not about saving a dollar here and a dollar there. This is about actually making a difference in your family's budget.

I will share some other case studies later on.

I know families who are using this coupon system to cut their food bill in half and nearly eliminate their budget for household goods, cleaners, personal care products and beauty products.

This system is being used by middle class families to extend their budget. The savings each month from their food budget and personal care budget are being used to pay down their debt. I will write a post about the fastest and easiest way to pay down your debt at another time.

In fact, this is such a savings to most families; studies have shown that a mom or dad that uses these saving strategies is worth $80 per hour! This is nothing to make light of!

As I was showing them I got hooked! Since I go to the store anyways I figured that it was time we started saving some money and use that money we save towards paying for the college bills we are paying and for paying down debt. We spend a lot of money on food, good food, healthy food. But those savings we'll talk about later on. For now, just see how FAT these savings are.

This is nothing to sneeze at!!! I don't care how much money you are making in real estate you can learn some frugal ways to save. Since we live in Florida and we are now approaching hurricane season, stocking up is a 'must do item' on your list. As soon as the storm warning hits- the stores' shelves empty within hours.

In just one month we have enough shampoo and conditioner for a year, enough razors for a year, enough body wash for a year and enough feminine products for a year. In this photo here between Walgreens, CVS and Publix and this is all non food items-

I bought $980 of products for $64.00 - that includes the 6.5% sales tax.

We still have lots of items to donate to the Military care packages, send our kids in college and give to homeless shelters.

If you are so rich that you don't need to save any money- you and your friends can do this for fun and then donate all your items to charity.

The video I posted below is ten minutes long so fair warning about that but it is well worth watching. I go through the items and explain how you can use them, etc. For instance, Nestor and I do not use any deodorants that contain the aluminum because we believe it may cause breast cancer. So we donate the free products that we don't use to our kids who refuse to listen to us about deodorants or we send it off in care packages or drop it off at the homeless shelters.

Palm Beach County Short Sales- Is Pressure Mounting For Homeowners Who Don't Pay Their Mortgage?

The biggest disconnect we believe in the short sale arena is the fact that the banks do not stop the foreclosure proceedings when you are trying to do a short sale. This creates so much stress on the homeowner, the buyer, the buyers' agents and the listing agent- always trying to get foreclosures postponed or slowed down.

Most often, the best process to follow is to hire a qualified and reputable attorney who will defend against your foreclosure.

We are seeing an increase of calls to collect payments, more aggressive conversations with homeowners and more negotiating being done with reps from the banks calling our sellers directly to offer deed in lieu(s) while we are in the process of doing a short sale.

Some sellers are surprised that they still get collection calls even after signing authorization forms giving us permission to talk to the lenders.

Of course we tell our sellers that these calls will happen. We have some sellers who just don't answer their phone anymore when the bank calls but we also have other sellers who want to continue a dialogue. I don't believe they really understand the scope of what they are engaging in when they have the conversations.

We have noticed an increase in the collection calls and an increase in trying to get the sellers to cancel their listings and do deed in lieu.

Remember that a deed in lieu is a foreclosure without going to court.

When you owe money to a bank and you do not pay your mortgage it is the bank's job to collect the money that you owe to them. You owe the money. So the bank is calling you to see what they can get out of you. When they start talking about how they are going to help you - keep in front of your mind- the bank is NOT there to help you. They are there to collect the payments you owe them.

You have to stay the course. There will be by the banks to persuade you off your course, there will be good intending friends and family members who will tell you a different path to go down. But the choice is only up to you. Whatever your choices are, you need to understand what those are, choose your path and then stay your course.

Florida Condos Get More Aggressive With New Laws

This week Florida Condo Associations got a big boost from Governor Charlie Crist when he signed a new law favoring the Condo Associations.

Now, pay attention those of you who live in Condos and are NOT paying your HOA fees and CONDO fees when you stop paying your mortgage, when you have walked away and left the keys on the table and even if you are working on getting a short sale approved!

Condo associations can now go after you for TWICE the amount of delinquent dues owed to them.

They were limited to six (6) months of dues in most cases. Also, the banks don't want to foreclose on Condos because then they will have to keep the units up, pay the dues and take care of maintenance issues and special assessments. Now the banks when they foreclose will have to pay one year's worth of back dues.

The new law also allows Condo Associations and Homeowner Associations to lock you out. That means no more access to your pool or other common-ground amenities.

This law also confirms the ability for the HOA and Condo associations to be able to rent out the condo units to collect the HOA fees without going to court. This will save money from the HOA budgets and expenses. They will be able to take over the units, rent them out and use that money towards the dues that are owed to them.

Another part of the new law is called: "Distressed Condominium Relief Act." This part of the law relieves the Condo Associations from delaying very costly improvements like upgrades to fire alarms, elevators and fire sprinklers.

In Florida the condo market was a hot, hot, buy where people stood in line for hours and sometimes parked overnight to put down a deposit on a unit that was not built. The units then were flipped over and over again, several times to make a profit. Then the developers ran around converting apartment buildings all over Florida to condos.

Boom, bust comes along and investors who got caught holding the hot potatoes walked away and stopped paying dues.

When we take short sale listings where there is an HOA or a Condo association involved we tell the sellers that a condition of our listing terms is that they must keep current with their HOA fees and Condo fees. If you are a listing agent- consider having some type of agreement like this.

In short sales the second biggest obstacle we run across are the lenders being really tough on paying these delinquent HOA fees.

We have had some sellers who were already so far behind that they could not catch up and we took the listing because we knew we could get all cash buyers to the table who would pay off the delinquent fees.

Is Your Glass Half-Full Or Half-Empty? A Different Paradigm

A popular question from positive attitude enthusiasts is:

Is the glass half full or half empty?

When you look at your glass half full you are considered to have a good attitude. It goes along with the adage: Life gives you lemons- make lemonade.

When you look at your glass and say that it is half empty all of a sudden, you are labeled as negative. You must be a pessimist. You must have a bad attitude. You know, the ones that complain about the lemons.

But is this really a fair way to do your positive attitude check up?

How about if you are just being logical or reasonable?

How you look at the glass depends on the circumstances- like most things in life- It all depends.

The logical conclusion to the question is that it is either neither or both.

When you are pouring something into your glass, it is half full.

When you are drinking from your glass, it is half empty.

And then you can come to another conclusion:

The glass is neither half empty nor every half full because it is always full.

If it is half full of liquid, the rest of the glass is filled with air.

If you are a pilot and you are in flight to your destination, look at your fuel gauge and it is in the middle between full and empty:

Do you look down at the gauge and say-" Oh, I have a whole half of a tank of fuel left! No problem! My tank is half full!"

Or do you look at the gauge and say, "Oh, my tank is half empty. I had better start looking on where I can land to refuel."

The responsible thinking is the pilot looking for a place to land and refuel. Because he should refuel- his tank is half empty. Is he being negative or logical?

It would be unrealistic to expect him to think any differently. So it is in life, in families and in your business.

But we can also look at the glass from a totally difference perspective:

What if you look at the glass as half empty and therefore are motivated to go and get it filled?

Would that not be positive instead of negative? And what if seeing it as half-full leads to complacency? The person who sees his life as a glass half-empty and that motivates him to change his life- isn't that now a positive rather than a negative?

There is a lot of meaning in emptiness. Tao writings contain a chapter on:

the importance of emptiness and that the empty glass is opportunity and therefore the person viewing the glass as empty is actually positive and not negative.

The lower part of the glass that is full would mean that another drop could not fit into that space. Yet the glass half empty would mean that there is much to fill. Emptiness is not nothingness.

The part of your life you have not lived yet are empty pages waiting for you to take the pen into your hand and write your own story. Those empty pages are your opportunity.

I am one who often gives the benefit of the doubt. Nestor is the one who works from reason and looks at reality. Most of the time he is right. I want to say he made it so through his thinking but you can not 'make' other people's thoughts.

There is a time and a place for positive attitudes and fortunately that is most of the time. However, negative thoughts often times are warning signals that your tank may just be half empty and you need to quickly look for a refueling station.

Strategic Short Sales In Palm Beach County Florida

Palm Beach County Short Sale Agents are experienced in strategic short sales.

The number of homeowners who are choosing to do strategic defaults is estimated to be at 31% this year up about 9% over last year's estimated 22%.

Strategic defaults are happening more in Palm Beach County Florida because their lenders are not approving loan modifications or refinances because the mortgages are too far under water to be approved. There is a huge disconnect between the homeowner and their lenders.

Around 10,000 homes were in some stage of foreclosure in Palm Beach County and Broward county in May of this year according to RealtyTrac Inc.

As this sore festers it turns into an infection of apathy. Most homeowners start off attempting to perform workouts with their lenders. Yet as their pleas fall on deaf ears they soon become hardened towards their lenders.

Active Rainers Nestor and Katerina Gasset- Speakers At Apple Business Networking Seminar

The business manager of the Apple Store here in town invited Nestor and I to be the presenters at the Apple Business Networking Seminar.

He asked us to speak about how we use the Macs and iPhones in our real estate business. Most of the people in attendance were fellow Realtors® who have been thinking about making the switch. There were also a few other entrepreneurs.

The video of our presentation is about 40 minutes long. It was funny because one of the Apple staff had their video camera all set up to video the presentation. I then took out my Apple Nano and asked one of the staff to video the seminar. The Nano is so amazingly steady, dependable and precise.

Nestor spoke first about how we get on the MLS now with IDS Links which is provided to all members of our MLS. He also talked about Daylite and other software and apps that he likes to use.

I can not get my video uploaded to youtube right now because it is longer than 10 minutes. I will have to do so some editing first, that may take a while:)

I then spoke about how we built our online and offline real estate newsletter with pages and how we make our own podcasts of our newsletters.

We met a sister team who manufactures Apple Lap Top Cases and matching iPod/phone cases. They were just approved by Apple to sell their cases in the online Apple Store. They really were interested in hiring us to help them with their SEO and online marketing campaigns. We are going to write a post about their entrepreneur story.

We also met an agent who is moving to Reno Nevada and contracted us to coach to help him kick off his real estate business in a new market. The networking even turned out to be very fruitful for us.

We went into the event with the intent to pay it forward. It ended up being a win/win event for all.

Flavors. me Is What Google Profiles Should Be Like!

Jamey Prezzi emailed me last night with a message that she found this cool site: Flavors.me.

What a fabulous way to create and work your personal brand.

Throughout this post I am highlighting some profiles that were made in Flavors.me.

I just started to set up my profile page. Flavors.me is a profile site. You can use your own domain. You build a page all about you. It is an online business card. You can make is as simple of fancy as you would like to make it.

It is like Google Profile but a whole lot better. You can add your own backgrounds and images. Real estate agents can make some very impressive backgrounds with their niche markets. If you are in the condo niche market you can do something along the lines of some of these city backgrounds. If you are working in waterfront niches, the water behind you would look great. If you are in luxury markets, you in front of an a luxury estate or even inside a gourmet kitchen would get the point across of who you work with.

Then you write the 'about you' part.

Then you add all your services. Right now Flavors. me has about 24 services but they keep adding more. So you add Twitter, Facebook, Linkedin, Posterous, Youtube and more.

When someone clicks on one of your services your stream shows up right in your flavors.me page.

Squatters May Be Taking Over Your Properties

If you have moved out of your property because you relocated out of the area or if you moved into a rental already because you are doing a short sale be aware that you may have opened up your property to squatters.

In one of our vacant short sale listings in Port St Lucie Florida- our sellers had to move closer to their jobs in Miami due to loss of income. They could no longer afford to pay for the gas to drive all those miles to and from work. So they rented a house close to the husband's work in Miami and called us to do a short sale on their property in Port St Lucie. They had it listed prior to calling us with buyowner.com who did not have a clue on how to do a short sale. Needless to say, we had to clean up the mess.

When we arrived to take photos of the vacant property we were met with a strong smell of pot. It was fresh. All over the house, there was evidence that squatters were living there or it could have become a teenage hang out to get high. We secured the house, called the locksmith to change the locks and bolted down the windows. However, no matter what the sellers and we did the squatters kept getting in. They even had power because one of the terms of our listing agreement is that sellers must leave their water and power.

This is happening more and more to our vacant listings. Sometimes we scare them away and sometimes we don't. A word of caution to agents- don't check on your vacant listings alone. Bring someone with you and be prepared to find anything.

There are squatters here in south Florida who are actually occupying vacant properties and telling the owners that they refuse to move out because they have a right to occupy the house because it was abandoned.

Here in Wellington Florida a man filed notice in the official county records that he was taking possession of 1000 homes in Broward county and 3 in Palm Beach County. He also took over 10 condos in North Lauderdale. He then rented out 6 of them and collected over $20,000 in rent. He was arrested but is pleading not guilty. His attorney says that he is a good samaritan and is saving these blighted homes.

Well, let's see. Condos are not blighted unless the HOA stops paying for services. So that is not likely going to wash for him in court. Also, the other properties depending on where they are located are mostly in good condition. All of our vacant short sale listings are in very good condition and ready to move into when we sell the properties to qualified buyers who actually get loans to buy their houses or pay all cash. On the other hand, we see a ton of rentals in bad shape because the tenants are not maintaining the properties. After all, they don't own the property.

The squatters and the people taking over multiple properties through these filings are using the "adverse possession" law that is dated back to 16th century England. Here in Florida, adverse possession can take place if the person using adverse possession pays the taxes, maintains the property and lives in the property or uses the property for a period of seven years.

This law is usually used here when there is an encroachment on one property from a neighbor, such as a fence.

But the other side of this coin is that you can not just break into a house and start living there without the probability of being arrested for trespassing. It is also illegal to collect rent money though trespassing.

Many homeowners live in their homes without getting foreclosed on and without making payments for up to 3 years but it is not likely that the bank will not foreclose within 7 years.

So the seven year rule is not likely going to be successful in court.

Be on the look out, protect your property rights. Pay your property taxes before they are delinquent, pay your HOA fees on time and try to stay in your property until your short sale is accepted by your lender. These issues can cloud your title which will make it very difficult to close on your property.

Homeowners have choices. Maybe a strategic short sale is the right option for you. It is most often better than just leaving the keys on the table and walking away.

Florida Beach Residents Lose Property Rights' Case In Supreme Court-

The U.S. Supreme Court ruled against Florida waterfront property owners by a vote of 8-0.

Some Florida homeowners who own property along the ocean waterfront were seeking compensation when sand restoration projects end up turning their private property along the beach into public beaches.

Here in Florida unlike many other ocean front locations you can own property right on the beach and you also then own the beach property making it private and off limits to the public.

But when there is a hurricane or other damage and the restoration includes bringing in sand to restore the property- when the sand is added it then makes that sand public sand, in other words, your ocean front property changes from being ocean front to being ocean view.

The beach restoration advocates made a claim in court that by adding the private rights protections it would slow down the process of the restoration.

The private property owners used the fifth amendment, property rights- government can not take private land and turn it into public land use without compensation.

The attorneys in behalf of the homeowner were very disappointed in the Supreme courts ruling stating that the justices have just as much duty to follow the fifth amendment as anyone else. The four conservative justices were ready to vote in favor of the private property rights but they did not have a fifth vote. Justice John Paul Stevens did not vote in the case because he owns an ocean front condo in Fort Lauderdale.

It is time to pay attention to your property rights. It is time to get involved in protecting your private property rights. It is time to pay attention to laws that are passed that hinder your private property rights and it is time to stand up for every one's private property rights no matter what state they live in and no matter how small or big of a parcel of land they own.

Palm Beach County Health Alert: Another Reason Why I Hate Mosquitoes!

Palm Beach County health officials have issued a warning:

Take measures to protect your livestock, yourself and your children.

A horse in Jupiter Florida had to be put down on June 23rd after getting very sick. The horse was bitten by mosquitoes infected with the Eastern equine encephalitis.

Eastern equine encephalitis is a killer of horses. It can also make humans sick and even kill humans although that is not common. It is carried by mosquitoes and birds.

Palm Beach County Mosquito control has started night aerial spraying to keep the mosquito population down. This is the first time in 30 years that Martin County has seen Eastern equine encephalitis in their sentinel flocks.

This is one of those times when I weigh whether I want to have poison on my body ie: mosquito repellent or get bit by one of those nasty creatures! I hate mosquitoes because I have bad reactions to their bites. One of my daughters is so allergic to bug bites that I would have to take her to the emergency room to get Benedryl shots in her backside before her throat constricted.

How Does Independence Work In Your Life?

As we are celebrating the Fourth of July- our country's Independence day it should become a time of reflection.

Our family has been doing a study of our founding fathers. It is amazing to me that men and women would sacrifice so much so that their posterity could enjoy living free. They each were in harms way, many of them were so poor that they fought in the Revolutionary war with no shoes and very hungry.

It makes me wonder how much would I do, how far would I go- to fight for freedom as they did? To sacrifice as they sacrificed? And would a call such as that ever be placed upon us in our generation? Could I even do what they did? Would I?

Independent means:

1) not subject to the control of others- self governing

2) not affiliated with a larger controlling unit

3) not looking for others for one's opinions or for guidance in conduct.

The synonym for independent is "free".

Doing a study of our country's road to independence should be a desire of each American.

Once we understand the history of our Independence we may develop a reverence for this day but also extend independence in our own lives.

When I think of independence I think about making my own decisions, being responsible for my decisions and my actions and to take control of my own destiny.

Independence is the opposite of dependence. As we look into our lives and the ways in which we behave we may ask ourselves, are we being dependent on others for approval, for security or for our well being? Are we turning over our power to others?

Perhaps this is a good time to do some reflection of our own behavior and the way we respond to what happens in our lives and in our businesses. We are in control if we choose to be.

We are free to make our own choices, if we choose to do so.
